This Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the Reservation Date written below by and between the undersigned person(s) or company (the “Guest”) and the undersigned owner, manager, or agent (“Rental Agent”), pursuant to which the Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.
OCCUPANCY
Guest agrees that no more than the agreed persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
CONDITION AND USE OF PROPERTY
The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, FreeView, or cable TV access as applicable. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
If the number of people permitted to occupy an apartment is exceeded (which would be in breach of Health and Safety Regulations) we reserve the right to move excess occupants and charge for additional apartments or require the excess occupants to vacate the property.
It is forbidden to use our properties for parties or gatherings where occupants of neighbouring apartments might be disturbed. If, on arrival, it is felt you are intending to use the property(s) for such an event you may be refused entrance. If it is discovered that you are holding such an event after arrival you will be required to leave immediately. In such circumstances, we are not obliged to provide or locate alternative accommodation. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbours, nor shall Guest use the Property for any immoral, offensive, or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.
LOSS OR DAMAGES TO PROPERTIES & PAYMENT OF ADDITIONAL CHARGES
Valid credit/debit card details must be supplied at the time of booking, in the event of loss or damages to the property these card details will be used to charge the appropriate fines. We reserve the right to deduct from the relevant credit/debit card all amounts chargeable under these conditions.
Guest shall use the Property for residential purposes only and in a careful manner to prevent any
damage or loss to the Property. The properties should be left in a reasonable state on departure, if (at our absolute discretion) we consider additional specialist cleaning is required (for example carpet cleaning to remove a stain), we will charge an additional fee of £100. When the duration of the booking is more than 28 days, a discretionary final cleaning charge of up to £200 may be charged if a property is deemed unfit for occupation, and you will be obliged to pay compensation to us for loss of revenues in addition to the costs of cleaning and repair.
We reserve the right to charge £200 (in addition to the general cleaning charges) for specialist cleaning to any property and/or its contents where it is left in an exceptionally bad condition or if we believe smoking has taken place in the room/apartment.
In relation to any additional charges the Guest is responsible for taking all reasonable care of the Property and its contents. The Property and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the hire period.
Additional charges can be levied up to ten (10) working days after the Guests have stayed in the property. In summary charges will be applied when any of the following provisions are met:
- Damage is done to property or its contents.
- Illegal activity, pets or additional services rendered during the stay.
- Pets are brought into the Property in breach of these terms and conditions
- All debris, rubbish and discards are not placed in rubbish bin, and soiled dishes are not cleaned.
- All charges accrued during the stay are not paid prior to departure.
- Linens are lost or damaged.
- Smoking takes place within the apartment.
- The renter is evicted by the owner (or representative) or the local law enforcement.
DAMAGES
Damages to the property or contents must be paid in full by you, card details to cover breakages and damages are required. In the event of any breakages or damage discovered whilst your stay or after you vacate, we will notify you by e-mail or telephone within five (5) days of your departure, providing a detailed breakdown of the damage and where is possible a cost for rectification. Where possible, photographic evidence will also be supplied.
The Guest will be responsible for making good any damage to the property or its contents which has occurred due to negligence, wilful damage, or irresponsible Behaviour on the part of those occupying the property or their guests. Such damage must be reported without delay with the cost of repair or replacement paid to Symphony Short Stays Ltd.
PETS
Pets are not permitted in our Property(s). The Guest is liable for any infringement of this rule, and Symphony Short Stays Ltd has the right to terminate your stay, if we deem such behaviour has occurred. In the event of such a breach, no refund will be made and a surcharge of £100 for additional cleaning will be made if evidence of pets is discovered in the Property.
SMOKING
Smoking is not permitted in the Property(s) or in the internal communal areas of the Property blocks. A surcharge of £200 will be made if evidence of smoking is discovered in any Property.
DEFAULT
If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings, and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
FORCE MAJURE
We shall not be liable for any failure or delay in performance of our obligations which results directly or Indirectly from any cause or circumstance which is beyond our reasonable control, including (but not exclusively) acts of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any licence or consent), fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken at the property, strikes, lockouts or boycotts, embargo and blockade.
INTERNET
You may not:
- Use the Service for any illegal purpose
- Access or attempt to access the Service provided to any other customer
- Use the Service in such a manner as to host a web or other server, send or facilitate the sending of bulk e-mail or collect third party personal data without appropriate consent
- Exceed typical bandwidths relevant to the period of Service
- Resell, or attempt to resell, the Service to any third party
You acknowledge that your use of the Service is at your own risk. The Service is provided on an “as-available” basis, and to the fullest extent permitted by law, we hereby exclude all and any warranties or conditions of any kind, whether express or implied, in respect of the Service and any content or data obtained or downloaded from it. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free always or will meet your requirements. We are not responsible for the security, integrity, accuracy, or completeness of any information that you transmit or receive while using the Service.
CHECK-IN, CHECK-OUT
Unless previously agreed in advance with Symphony and solely at our discretion
Check-in is from 3.00pm
Check-out is by 10.00am
If you fail to arrive by midnight on the day of the start date and do not advise us of a late arrival, we may treat the booking as being cancelled by you. If there is a delay in departing, we reserve the right to charge for an additional night’s stay for every day the keys are not returned.
Any items left in a Property past the agreed departure time are left at the Guest’s risk – we accept no responsibility for these items and reserve the right to remove and store them. Lost property can be posted back to you at your own cost with prior agreement, Symphony Short Stays Ltd accepts no liability for any items that go missing.
LOST, DAMAGED OR NON-RETURNED KEYS
One set of keys will be provided upon check-in in a lockbox and must be returned to the lockbox at the end of Guest’s stay. If the keys are not returned, we reserve the right to charge Guests for replacements at a cost of £50. If at any time the Guest loses the keys, they must notify us as soon as possible.
ASSIGNMENT OR SUBLEASE
Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement.
RISK OF LOSS
Guest agrees that all personal property, furnishings, personal affects, and other items brought into the Property by Guest or their permitted guests and visitors shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any reason whatsoever.
Other than in relation to death or personal injury caused by our negligence, or any other liability that by law cannot be excluded or restricted, our liability to you in relation to these conditions is limited to the value of the booking made with us.
INDEMNITY
You hereby indemnify us and undertake to keep Rental Agent indemnified against any losses, damages, costs, liabilities, and expenses incurred or suffered by us arising out of any breach by you of any provision of these terms and conditions or arising out of any claim that you as the Guest have breached any provision of these terms and conditions as well as relating to any claims regarding the destruction of property or injury to persons or loss of life sustained by Guest or family and visitors of Guest in or about the Property.
ENTRY AND INSPECTION
Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to prospective purchasers, renters or other authorized persons. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
CANCELLATION POLICY
If Guest cancels at least 14 days before check-in Guest will get back 100% of amount paid. If cancellation is between 7 and 14 days before check-in, 50% of total amount paid will be refunded. If Guest cancels 7 or fewer days before check-in a refund will not be applicable.
UNAVAILABILITY OF PROPERTY
In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, we shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Symphony Short Stays Ltd shall have no further obligations or liabilities in any manner pertaining to this Agreement.
ADDITIONAL TERMS TO THE RENTAL AGREEMENT
In addition to the standard terms included herein, Guest acknowledges and agrees that the following additional terms and conditions apply to the Guest’s rental of the Property:
- You must be 21 years or over when you book your accommodation.
- We reserve the right to refuse to accept any booking.
- Should payment not reach us within the required time we reserve the right to cancel any bookings made and any deposit paid will be forfeit.
- The cancellation terms agreed on Airbnb and Booking.com will override cancellation policy above
GENERAL PROVISIONS
This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. This Agreement shall be governed by the laws of the United Kingdom. The words “Rental Agent” and “Guest” shall include their respective heirs, successors, representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected.
Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature.
